Family Law
Family law covers legal issues arising from family relationships, including marriage, divorce, and child custody. In Malaysia, the applicable law differs between civil and Syariah jurisdictions, depending on the parties’ religion and marital status.
1. Divorce Petition
A divorce petition initiates the legal process to dissolve a marriage under the Law Reform (Marriage and Divorce) Act 1976 for non-Muslims. It may involve contested or joint petitions, addressing issues such as maintenance, custody, and division of matrimonial assets.
2. Child Custody
Child custody proceedings determine who will have care and control of a child following a divorce or separation. Malaysian courts prioritise the welfare and best interests of the child, taking into account factors such as the child’s age, education, and emotional well-being.
3. Asset Allocation
Asset allocation refers to the division of matrimonial property following the breakdown of a marriage. The court considers each spouse’s contribution—both financial and non-financial—when determining how assets should be distributed equitably under Malaysian family law.
